Heather Nolan is a media, advertising, promotions and intellectual property lawyer, who works closely with clients to help develop, launch and administer their marketing communications and promotions and in all media platforms.  As Senior Counsel with the Information Law Group, Heather’s practice covers the spectrum of traditional and emerging advertising, promotions, and intellectual property issues. She regularly works on sweepstakes, skill contests, charitable promotions, coupons, rebates, web sites, mobile apps, and trademark matters, as well as e-mail, text message, mobile marketing, and viral marketing campaigns, and all related agreements and campaign elements.

Heather previously practiced as an associate in the Intellectual Property Group of Wildman, Harrold, Allen & Dixon LLP in its Chicago office.

Heather’s representative experience includes:

  • Counseling on legal compliance related to advertising and promotions in all forms of traditional and emerging media, including sweepstakes, skill contests, charitable promotions, coupons, rebates, web sites, mobile apps, as well as e-mail, text message, mobile marketing, and viral marketing campaigns.
  • Drafting and negotiating transactional documents related to promotions, including sponsorship, co-promotion, licensing, agency and other e-commerce, technology, marketing and promotion agreements.
  • Counseling on privacy issues related to marketing practices, web sites, data collection and use, auditing web sites and other public-facing communications and platforms, and drafting terms of use and privacy policies.
  • Counseling and representing clients in domestic and foreign trademark prosecution, maintenance, and enforcement matters, as well as domain name registration, maintenance, and arbitration under the UDRP.
  • Representing clients in various adversarial intellectual property matters, with special focus on trademark matters.
  • Counseling and representing clients in the areas of computer fraud, computer and network security, and cyberstalking.
